By accessing or using The Communication Gym website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.

We may update these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, for significant changes, by email. Continued use after changes constitutes acceptance.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into agreements. If using on behalf of an organization, you represent that you have authority to bind that organization.

4. Account Responsibilities

You are responsible for maintaining the security of your account and password. You agree to provide accurate information and notify us immediately of any unauthorized access.

5. Our Services

The Communication Gym provides communication coaching and training services, including AI-powered coaching, human coaching, courses, and assessments. Service details are described on our website and in program materials.

6. Payments

Payments are processed through Stripe. By purchasing, you authorize us to charge your payment method. Subscription terms, pricing, and billing cycles are shown at checkout. Refunds are governed by our Refund Policy.

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal or internal business purposes. You may not copy, distribute, modify, or commercially exploit our content without permission.

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee specific results. Our services are for professional development only and are not therapy, medical treatment, or professional advice in regulated fields.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMMUNICATION GYM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

You agree to indemnify and hold harmless The Communication Gym from claims arising from your use of the Services, violation of these Terms, or violation of any third-party rights.

You may terminate your account at any time by contacting us. We may suspend or terminate your access for violation of these Terms or for any reason with notice. Upon termination, your license ends and we may delete your account data.

These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved through binding arbitration in San Francisco County, California, except that either party may seek injunctive relief in court.

These Terms, along with our Privacy Policy, Cookie Policy, Refund Policy, and Coaching Services Agreement, constitute the entire agreement. If any provision is unenforceable, the remainder continues in effect. Our failure to enforce any right is not a waiver.
